Terms & Conditions.

These terms apply to personal training, strength and conditioning coaching, football performance coaching, online coaching, consultations, training programmes and purchases made through Gerald Fitness.

01 Who These Terms Apply To

These Terms & Conditions apply to services supplied by Gerald Latifi trading as Gerald Fitness, including personal training, strength and conditioning coaching, football performance coaching, consultations, online coaching, training programmes, session bookings and training packages.

By purchasing a paid service, booking a session, creating or using a client portal account, or instructing Gerald Fitness to begin providing a service, you agree to these terms. Nothing in these terms affects your statutory consumer rights.

02 Bookings & Payment

  • Paid sessions, packages and training programmes must be paid in advance unless Gerald Fitness agrees otherwise in writing.
  • Prices shown at the time of purchase apply to that booking or package and are displayed in pounds sterling.
  • Online payments may be processed securely through Stripe, WooCommerce and the Gerald Fitness client portal.
  • A purchase or booking is confirmed once payment has been successfully processed and confirmation is provided through the website, client portal or email.
  • You are responsible for checking that the service, package, appointment details and contact information supplied at checkout are correct.

Where you buy online, confirmation of the purchase and access to these terms should be capable of being saved or retained for your records.

03 Sessions, Packages & Expiry

Gerald Fitness may offer single personal training sessions and multi-session packages through the website or client portal. Package credits may be used to book eligible sessions within the relevant validity period.

Service Type Validity / Use
Single personal training session Used for the appointment selected or subsequently rearranged in accordance with these terms.
Personal training packages Unless stated otherwise at the time of purchase, package credits expire 30 days from the purchase date.
Custom training programmes / online coaching Delivered or provided for the period described at purchase or otherwise agreed with the client.
  • Unused personal training package credits remaining after the stated expiry date will expire unless an extension has been approved.
  • Extensions may be considered where reasonable circumstances prevent use of the package, but are not automatically guaranteed.
  • Any different validity period shown on the booking or checkout page at the time of purchase will take priority for that particular package.

04 Cancellation & Rescheduling Policy

The following appointment policy applies once a training session has been booked, subject always to any statutory cancellation rights described in section 5.

  • A minimum of 24 hours’ notice is required to cancel or reschedule a booked training session without losing that session credit or payment.
  • Where less than 24 hours’ notice is given, the booked session may be charged in full or deducted from the client’s package balance.
  • A failure to attend a booked session without notice may result in the session being charged in full or deducted from the package balance.
  • Where Gerald Fitness needs to cancel or rearrange a session, the session will be rescheduled or the relevant unused session value will be returned or refunded where appropriate.

Cancellation or rescheduling should be requested through the available booking/customer panel functions, or by contacting Gerald Fitness directly where the portal does not permit the requested change.

05 Online Purchases & Cooling-Off Rights

Where you purchase a service online or by another distance method as a consumer, you may have a legal right to cancel within 14 days of entering into the contract, without giving a reason, unless an applicable exception applies or the right has been lost in accordance with the law.

Starting services during the cancellation period

Where you ask Gerald Fitness to begin providing a paid service during the 14-day cancellation period, such as attending a session, beginning online coaching or preparing a programme, you may be required to pay a reasonable amount for the service provided before you cancel.

Where a service has been fully performed during the cancellation period after your express request and acknowledgement, your right to cancel may be lost once the service has been fully completed.

Digital or electronically supplied programme content

Where digital training content or a downloadable programme is supplied immediately, you may be asked to expressly agree to supply beginning during the cancellation period and acknowledge that you may lose your cancellation right once access to or supply of the digital content begins, where permitted by law.

The usual package-expiry, late-cancellation and non-refundable-service rules do not remove any statutory cancellation, refund or consumer rights that apply to you.

How to exercise a cancellation right

To cancel within an applicable statutory cancellation period, send a clear statement to info@geraldfitness.co.uk identifying your purchase and stating that you wish to cancel.

06 Late Arrival & Attendance

  • Please arrive ready to begin at the scheduled session time.
  • If you arrive late, the session may still finish at the originally scheduled end time to avoid affecting other bookings.
  • If you are more than 15 minutes late, Gerald Fitness may treat the session as missed where it is no longer practical or safe to deliver a useful session.
  • Where a session is treated as missed due to late arrival, it may be charged in full or deducted from your package balance.

07 Health, Safety & Screening

Exercise involves physical effort and may involve risk. Before beginning coaching, you must disclose relevant health information that may affect safe participation, including injuries, medical conditions, symptoms, recent surgery, pregnancy, prescribed restrictions or any concerns relevant to exercise.

  • You may be required to complete a health-screening questionnaire or PAR-Q before taking part in coaching.
  • You must notify Gerald Fitness if relevant health information changes during your coaching relationship.
  • You should stop exercising and seek appropriate medical attention if you experience concerning symptoms during or after exercise.
  • Gerald Fitness provides coaching and exercise guidance and does not provide medical diagnosis or medical treatment.

Gerald Fitness may pause, adapt or decline training where there are reasonable safety concerns or where medical clearance is considered necessary before continuing.

08 Coaching for Under-18s

Where coaching is requested for a person under the age of 18, appropriate arrangements must be discussed with a parent or legal guardian before coaching begins.

  • A parent or guardian may be required to give permission, provide relevant safety information and complete required documentation.
  • Training location and supervision arrangements must be suitable for the young person and the type of coaching provided.
  • Some gym-based sessions may be restricted by venue age-access rules. Where relevant, alternative suitable training arrangements may be discussed.

09 Online Coaching & Training Programmes

Online coaching or programme services may include video consultations, exercise programming, training plans, progress support, messages, feedback and digital documents as described at purchase or agreed with the client.

  • You are responsible for ensuring you have appropriate space, equipment and conditions to perform training safely when exercising independently.
  • You should follow the exercise instructions, technical guidance and any recommended progression limits provided.
  • Where you are unsure how to perform an exercise safely, you should seek clarification before continuing.
  • Any customised plan is prepared using the information you provide; you are responsible for informing Gerald Fitness of relevant health, injury or availability changes.

10 Training Locations & Access

Training may take place at an agreed gym, suitable outdoor location, online, or another agreed setting depending on the service arranged.

  • Where sessions take place at Anytime Fitness Abbey Wood or another venue, access is subject to that venue’s applicable entry and conduct requirements.
  • You must follow reasonable safety instructions and any relevant venue rules during in-person training.
  • Where travel, home visits, outdoor coaching or alternative facilities are arranged, any additional arrangements or costs will be confirmed before booking where applicable.

11 Results, Conduct & Communication

Results

Gerald Fitness will provide coaching with reasonable care and skill. Individual results cannot be guaranteed because progress depends on factors including attendance, consistency, recovery, nutrition, health, effort, lifestyle and adherence to the agreed plan.

Conduct

  • Clients are expected to communicate and behave respectfully towards Gerald Fitness, other clients, venue staff and members of the public.
  • Gerald Fitness may end or pause a session where behaviour is abusive, threatening, discriminatory, unsafe or inappropriate.
  • Repeated inappropriate or unsafe behaviour may result in the coaching relationship being ended. Any financial outcome will be considered fairly in the circumstances and in accordance with applicable consumer rights.

12 Liability

Gerald Fitness will provide services with reasonable care and skill. Clients remain responsible for following instructions, disclosing relevant information and exercising appropriately between coached sessions.

Gerald Fitness is not responsible for loss or injury caused by information withheld by the client, failure to follow reasonable coaching or safety instructions, unsafe independent activity, misuse of equipment, or circumstances outside Gerald Fitness’s reasonable control.

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory rights as a consumer.

13 Refunds, Complaints & Service Issues

Refunds

Once any applicable statutory cancellation right has expired or been properly lost, payments for completed sessions, missed sessions charged under the cancellation policy, used package credits or services already delivered are generally non-refundable unless Gerald Fitness agrees otherwise or you have a legal right to a refund.

Where Gerald Fitness cannot provide a paid service that has not yet been delivered, an appropriate rearrangement, account credit or refund will be offered depending on the circumstances.

Complaints

If you are unhappy with a service, booking, package or payment issue, please contact Gerald Fitness as soon as possible so the concern can be considered and, where appropriate, resolved fairly.

Complaints should be sent to info@geraldfitness.co.uk with your name, relevant booking or order details and a clear explanation of the issue.

14 Privacy, Changes & Governing Law

Privacy

Personal information is handled in accordance with the Gerald Fitness Privacy Policy, including information provided for bookings, coaching, payments, health screening and use of the client portal.

Changes to these terms

Gerald Fitness may update these Terms & Conditions from time to time. The terms that applied when you made a purchase or booking will continue to apply to that purchase unless a change is required by law or is agreed with you.

Governing law

These terms are governed by the laws of England and Wales. Any dispute shall be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory consumer rights that apply.
